The mandate requires that drivers track their Hours of Service (HOS) electronically, which will cut down on time spent on paper logs and can reduce losses from HOS fines. But the potentially burdensome aspect of the ELD mandate is that the software must be synchronized with the truck's engine in order to record driving activity and transfer data in real time, and the device must meet the stringent requirements set by the FMCSA. In his letter, Hill cites "undue burdens" placed on drivers and operators as his reasons for calling for a delay. While the Indiana AG believes that some sort of ELD requirement would be beneficial, he maintains the current mandate isn't ready for implementation.
The Attorney General's major complaint is the process of self-certification from manufacturers of ELDs, stating that a device claiming to be compliant may not actually be, since there is no oversight from government authorities. If truck operators are going to invest millions of dollars in new equipment, Hill argues, they need to be certain that it will comply with FMCSA demands. And to date, there is no way to hold device manufacturers responsible if they label their product as compliant but it is later determined not to be. Hill also points out that FMCSA requirements and checklists posted to their website are incomplete and too complicated, despite the looming due date for compliance. Hold off on the mandate, the Attorney General insists, until there is more clarity surrounding device certification, testing processes, and successful deployment.
Hill's position is shared by many in the industry, and nationwide protests are being held in the weeks leading up to the December 18th due date, but time will tell if the FMCSA will seriously consider the complaints and take any action.
